GENERAL TERMS AND CONDITIONS
1. General / contractual performance
The General Terms and Conditions (GTCs) apply to all products purchased through www.katjabouwman.com ("we" / "us"). By submitting an order, you (the "customer") expressly agree to these GTCs.
2. Contract
A sales contract is concluded when the customer receives an automated order confirmation email from www.katjabouwman.com. This email confirms the conclusion of the sales contract and at this point, changes or cancellations to the order are no longer possible.
3. Copyright
The author of the photographs offered on www.katjabouwman.com is the photographer Katja Bouwman. By purchasing a product that contains photographs made available on www.katjabouwman.com, the customer acquires only the physical ownership of the product. The customer does not acquire any rights to use, reproduce, distribute, modify, or make the photographs available to the public. Such actions are strictly prohibited.
4. Offer & Products
The prices listed in our offers and order confirmations are in CHF (Swiss Francs) and are binding. Prices include packaging, while shipping charges will be calculated at checkout. www.katjabouwman.com is not subject to VAT. www.katjabouwman.com endeavors to provide accurate product information. Minor technical deviations (e.g., image cropping and color differences in print) are permissible and do not constitute defects, as long as they fall within acceptable limits and do not significantly affect the intended use of the product. Product images on the website may vary from the actual product due to screen settings or other technical factors. These images serve an informational purpose and we strive to present our products as accurately as possible. We do not accept liability for the accuracy, completeness, or up-to-dateness of the information provided. www.katjabouwman.com reserves the right to change prices and product offerings at any time.
5. Delivery & delivery times
Delivery times are provided as estimates and are not binding. www.katjabouwman.com strives to meet the stated delivery times, but delays may occur. Products are produced after the contract is concluded. If, in exceptional circumstances, we are unable to meet the agreed delivery times or if the product is no longer available, we will contact the customer by email or phone and the customer will receive a refund.
The customer must inspect the goods upon arrival for correctness, completeness and integrity. Any transport damage must be reported and documented immediately, no later than five calendar days after delivery. We aim to produce and deliver all ordered products as quickly as possible. Delivery of prints usually takes 10-14 business days.
We reserve the right to make partial deliveries. In case of delivery disruptions outside of our control, such as force majeure, we reserve the right to withdraw from the contract without liability for damages. In such cases, any pre-paid amounts will be refunded.
If you fail to make a payment, we reserve the right to suspend further services. Payments will be applied in chronological order to outstanding debts, interest, and costs.
6. Terms of payment
Payments can be made by credit card or Apple Pay. Shipment will only take place after successful verification of credit card or Apple Pay details.
All prices are retail prices that include packaging and shipping costs.
Additional shipping costs resulting from incorrect delivery addresses provided by the customer will be charged to the customer.
7. Ownership
Ownership of the goods remains with www.katjabouwman.com until full payment has been received and the goods have been delivered.
8. Loyalty programmes / vouchers
Vouchers are valid only within the specified period and can only be redeemed once during the online order process. Vouchers cannot be exchanged for cash. www.katjabouwman.com reserves the right to modify or withdraw loyalty programs at any time.
9. Return
The right of withdrawal and return is excluded for products that are manufactured according to the customer’s specifications and tailored to personal needs. All products offered on www.katjabouwman.com are made-to-order ("on-demand"). As such, all photo products are excluded from the right of return.
10. Links
www.katjabouwman.com may provide links to external websites over which we have no control. Similarly, third-party websites may link to www.katjabouwman.com. The customer should exercise caution and read the terms and conditions of these third-party websites.
11. Liability
To the fullest extent permitted by law, www.katjabouwman.com excludes all liability for the products sold and delivered.
12. Final provisions
All legal relationships between the customer and www.katjabouwman.com are governed by Swiss law. www.katjabouwman.com reserves the right to modify these general terms and conditions at any time. The current version of the GTCs can be viewed and printed at any time on www.katjabouwman.com. The place of jurisdiction is the registered office of www.katjabouwman.com. The language available for the conclusion of the contract is English.
